A “User,” “Participant,” or “You” refers to any individual accessing our Website or utilizing, enrolling in, or benefiting from the Services offered by the Organization, encompassing program recipients, their family units, prospective or current volunteers, and donors. The “Website” or “Platform” specifically denotes the GHAMA official domain (ghama.site) and any associated subdomains, digital portals, or managed social media presences utilized for communication and resource dissemination. Finally, “Services” is a broad term encompassing all physical and digital offerings provided by GHAMA, including, but not limited to, one-on-one mentorship, workforce development workshops, resource navigation assistance, social and emotional development groups, community events, and access to all digital informational materials and databases provided through our network at the Ione center and online.
Non-Discrimination and Eligibility for Services

Eligibility for our Services is determined solely by the need demonstrated by the individual or family unit and the specific requirements of the program being accessed. We uphold a zero-tolerance policy regarding physical aggression, threats of violence, or any behavior that compromises the safety or emotional well-being of others on our premises or during Organization-sponsored activities. Any violation of this conduct policy, particularly those involving disrespectful or aggressive behavior, will result in immediate termination of the individual’s access to all Services, potentially including permanent prohibition from the GHAMA premises, as the safety and psychological security of our community is non-negotiable and paramount to the delivery of effective guidance.
Confidentiality and Group Participation

4. Limitation of Liability and Disclaimer of Warranties
Acknowledgment of Services “As-Is”
You expressly acknowledge and agree that your use of the GRACEFUL HEARTS AMADOR Services and Website is at your sole risk, and that all resources, guidance, informational content, and programs are provided on an “as-is” and “as-available” basis, without warranties of any kind, whether express or implied. While we strive to ensure all information provided is accurate and current, we cannot warrant the completeness or reliability of external resources we may refer you to, nor can we be held liable for any decisions made by you based on the general informational content provided on the Website.
Limitation of Organizational Liability

In no event shall the total, aggregate liability of GHAMA to you for all damages, losses, and causes of action exceed the greater of one hundred U.S. dollars ($100.00) or the amount, if any, paid by you to the Organization for the specific services giving rise to the claim during the six (6) months preceding the date of the claim.

This means that if any GHAMA staff member or authorized volunteer receives information or reasonably suspects that a child (under 18 years of age), an elder (over 65 years of age), or a dependent adult is being abused, neglected, or exploited, or if an individual poses an imminent and credible threat of serious bodily harm to themselves or to another specific, identifiable person, we are legally and ethically obligated to report this information immediately to the relevant law enforcement or protective services agencies. By making a donation, you acknowledge and agree that the transaction is a final, voluntary, and non-refundable contribution. As a non-profit organization, we utilize donated funds immediately for mission-critical purposes, such as funding mentorship training, stocking our resource center, and covering operational costs necessary to maintain our safe, welcoming environment. Therefore, GRACEFUL HEARTS AMADOR maintains a strict no-refund policy for all monetary donations received, except in the highly unlikely event of a documented, technical processing error resulting in an incorrect charge, which must be reported immediately upon discovery to our financial office for review and verification.
Tax Deductibility and Financial Acknowledgment
You acknowledge that while GRACEFUL HEARTS AMADOR is a registered 501(c)(3) non-profit organization, the tax deductibility of your contribution is solely your responsibility, and you should consult with your own tax advisor to determine the exact tax treatment of your donation based on your individual financial circumstances. We are committed to providing timely and accurate financial acknowledgments, including official donation receipts, as required by law for all contributions meeting the necessary thresholds for tax documentation, which will be sent to the contact information provided during the transaction process. 8. Terms for Volunteers and External Partners
Volunteer Relationship and At-Will Status

By signing up to volunteer, you agree to adhere fully to these Terms, the Participant Code of Conduct, and any specific policies, training requirements, and supervision instructions provided by the GHAMA staff, particularly those concerning the confidentiality and security of participant data. You understand and acknowledge that your relationship with the Organization is strictly voluntary and at-will, meaning either you or GHAMA may terminate the volunteer relationship at any time, for any reason or no reason, with or without notice. Volunteers are not considered employees of GHAMA and are not entitled to any compensation, employee benefits, or insurance coverage except for what is explicitly mandated by law or specifically provided in writing by the Organization’s Executive Director for certain organizational liability protections.
External Partner Agreements
Any formal relationship between GRACEFUL HEARTS AMADOR and an External Partner (including other nonprofits, governmental agencies, or local businesses) for the purpose of resource sharing, joint programming, or service referral is governed by a separate, specific written agreement, memorandum of understanding (MOU), or contract executed by authorized representatives of both entities. These Terms and Conditions apply only to the use of the general Services and Website by the partner’s employees or agents, not to the terms of the formal partnership itself. The Organization is physically located in and operates primarily from Ione, Amador County, California, and the services provided are explicitly aimed at the residents of this region. Informal Dispute Resolution

Severability, Waiver, and Entire Agreement
